These “Terms and Conditions” regulate access to our website CasaTica in Costa Rica and its use by all users or consumers. By using our products and services, users, suppliers, merchants, or any customer agree to accept all the presented terms and conditions.

CasaTica is an internet platform owned by Esteban Zuñiga Arguello and Jose Alfredo Rodriguez Siles. The company is duly accredited and registered in accordance with Costa Rican legislation, making it the rightful owner of CasaTica intellectual property rights.

Once a user accesses our website, they tacitly accept the terms and conditions.

CasaTica reserves the right to make necessary updates to the website without prior notice, and these updates will be governed by the outlined terms and conditions of use.

Users understand and agree that they must periodically review the page’s updates. CasaTica will not be held responsible for any consequences resulting from users’ failure to heed this indication, including clients and suppliers.

FIRST: Users understand and accept that CasaTica maintains electronic communications via the provided information (email) upon initiating the service. Users will receive promotional and advertising emails, which can be suspended upon request by emailing us.

Users commit to providing accurate, current, and precise information, as well as keeping it up to date. CasaTica will not be liable if the user’s failure to update this information results in them not receiving the requested service or product, including promotional or other relevant communications.

SECOND: Every user when registering at CasaTica will create a confidential password that will allow them to carry out all transactions within our page. It will be the user's responsibility to safeguard the password. CasaTica is not responsible for the use of said password by third parties.

THIRD: CasaTica reserves the right not to accept the registration of physical or legal users, whether they are clients, suppliers or merchants of any type, without having to justify the reasons, also to suspend in the event of obvious violations of these terms, bad practices or abuse by users.

CasaTica, in full compliance with the Law on the Protection of Persons against the Processing of their Personal Data 8968, will keep sensitive information encrypted. It will not be responsible in cases where users disclose this information to third parties.

FOURTH: The information on services, products, prices and others from CasaTica may be modified, updated or replaced without prior notice, without incurring any responsibility. Every user must constantly consult the page to find out about updates.

FIFTH: Products or services may be in limited quantities and subject to return or exchange according to our return policy.

CasaTica has carried out the visualization work of all products and services with a standard of colors and high resolution images, however, this may vary depending on the users' monitor, for which reason CasaTica has no responsibility for any variation to the time of delivery due to color or presentation.

CasaTica may limit the quantities ordered of a product or suspend shipments without prior notice.

TENTH: CasaTica will not be held responsible for service suspension events due to causes beyond its control, due to fortuitous events or force majeure. In cases of maintenance of the CasaTica system, it may suspend the service indefinitely and without prior notice.

In no event will CasaTica, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors, be liable for any damage, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, as a result of the use of any of the services or products purchased through the service, or for any other claim related in any way to the use of the service or any products, including, but not limited to, any error or omission in any content, or any loss or damage of any kind, incurred as a result of the use of the service or any content (or product) posted, transmitted, or made available through the service, even if advised of its possibility. Because national laws do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

ELEVENTH: The user agrees to indemnify, defend and hold harmless CasaTica and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, concessionaires, service providers, subcontractors, suppliers, interns and employees, from any claim or claim, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be effective to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms of Service. Terms of Service, such determination shall not affect the validity and enforceability of the other remaining provisions.

TWELFTH: The user may suspend the service, but the commitment to confidentiality of the information received due to the use of the CasaTica platform will never expire. Damages and losses resulting from the use or abuse of information will authorize you to proceed with the necessary legal instruments to be compensated and will entail the fines and sanctions determined by Costa Rican legislation.

THIRTEENTH: RETURN POLICY:

Returns apply only in case of product defects or manufacturing damage. The user understands that, among the return policies, they must report the defective product to Customer Service within a maximum period of 1 day from the moment they receive it. The product must be returned in the same condition in which it was delivered and must retain its original packaging and labeling. It must include the invoice and in cases where applicable, the included accessories of the product(s) must also be delivered. Products that are sealed can be returned without a seal, only in case of manufacturing defects or damage, it will be necessary to ensure that the product has not been used/installed and is in its original conditions. (no wear and tear).

Once we have the product in our possession, the failure or defect indicated by the user is reviewed and when verified, we proceed with the change of the product or, the user is left with the balance in favor of the amount paid, which can be used to place another order within a maximum period of 3 months, after the indicated time passes the user will not be able to claim said balance. If, on the other hand, the product diagnosis does not confirm the failure or defect, the product will be returned to the user.
If the money back is applied, the user understands that it will be done in the same way in which they made the payment: card payments through the page are made directly to the card with which they paid, this procedure does not It is carried out by CasaTica, it is a procedure carried out directly by the bank and it can take 8 to 10 business days.
The user understands and accepts with his affiliation to CasaTica that requests for a refund for a purchase, due to the user not wanting the product or due to dissatisfaction with the product and having already made the payment, do not apply. It is important that you review the descriptions on the product sheet and make sure that you are purchasing what you need before making the payment, this includes compatibility, functions, features.

IMPORTANT:

For hygiene reasons, exchanges or returns of the following products are not accepted:

Sandals, footwear.
Caps, hats, glasses.
Any skin care product: body, face and hair.
Creams, perfumes, nail paints, makeup.
Compresses, masks.
Imitation jewelry.
Foods, supplements, vitamins.
Swimwear or underwear.
Bottles.

FOURTEENTH: Of the delivery process. Order dispatch hours within the Central Valley or our coverage areas are from 8:00am to 5:00pm from Monday to Friday. It is not shipped on Saturdays, Sundays and holidays, except for some exceptions, seasons or promotions. Due to logistics policies for the delivery of orders, the user understands and accepts that the courier will not be able to specify a delivery time for the order; it will be the user who must be aware of the agreed day for delivery within the included time.

The shipping cost has a value of ¢4,000 and this is charged from any product that costs less than ¢35,000; For products that, on the other hand, have a value greater than ¢35,000, the shipping cost will be completely free.
International Inventory Products: We have a stock of products that are in our warehouses abroad, which is why they have a delivery time of 8 to 10 business days. Each of these products has a delivery time note in their information. Keep in mind that being abroad the delivery time could sometimes be subject to changes, due to eventualities with bad weather, customs and others.

FIFTEENTH: The privacy policies, confidentiality, and any other regulations regarding the use of the platform are part of these conditions. The user may not claim ignorance of them.

Everything that is not indicated in these Terms and Conditions will be regulated by Costa Rican and international legislation on computer crimes, iCloud, i – commerce (digital commerce), the Civil Code, Commercial Code, Competition Promotion Law and effective consumer defense No. 7472 and its regulations, Law on the Protection of the person against the processing of their personal data No. 8968 and its regulations, Penal Code Law on Trademarks and other distinctive signs No. 7978 and its regulations, Observance Law of Intellectual Property Rights No. 8039 and its regulations, Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), and other laws that regulate the matter.
